Acceptance of Terms

By downloading, installing, or using the SQWD mobile application or website (sqwd.app), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use SQWD. These Terms constitute a legally binding agreement between you and Sqwd LLC ("we," "our," or "us"), the operator of SQWD.

Eligibility

You must be at least 13 years of age to use SQWD. By using the app, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Your Account

To use SQWD, you must create an account. You agree to:

• Provide accurate and truthful information when registering
• Keep your account credentials confidential and not share them with others
• Be responsible for all activity that occurs under your account
• Notify us immediately at support@sqwd.app if you suspect unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use

You agree to use SQWD only for lawful purposes and in a manner consistent with its intent — connecting athletes to find people to play sports with. You must not:

• Harass, bully, threaten, or intimidate other users
• Post or share content that is defamatory, obscene, or discriminatory
• Impersonate any person or misrepresent your identity
• Use the platform for commercial solicitation, spam, or advertising without our consent
• Attempt to gain unauthorized access to any part of the platform or its systems
• Scrape, crawl, or systematically extract data from SQWD
• Upload viruses, malware, or any code intended to interfere with the platform
• Violate any applicable local, state, national, or international law

User Content

You retain ownership of the content you submit to SQWD (profile photos, messages, posts). By submitting content, you grant Sqwd LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content solely to operate and improve the platform.

You are solely responsible for the content you post. We do not endorse any user-submitted content. We reserve the right to remove any content that violates these Terms or that we deem harmful to our community, without prior notice.

Privacy

Your use of SQWD is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using SQWD, you consent to the data practices described in the Privacy Policy.

Intellectual Property

All content, features, and functionality of SQWD — including but not limited to the SQWD name, logo, design, text, and software — are the exclusive property of Sqwd LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Disclaimers

SQWD is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the platform will be uninterrupted, error-free, or free of harmful components. We are not responsible for the actions, content, or conduct of other users of the platform. Physical activities arranged through SQWD carry inherent risks — you participate at your own risk.

Limitation of Liability

To the fullest extent permitted by law, Sqwd LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of or inability to use SQWD, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) $100 USD.

Termination

You may delete your account at any time from within the app (Profile → Delete Account). We reserve the right to suspend or terminate your access to SQWD at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use SQWD ceases immediately.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email. The "Effective date" at the top of this page will reflect the most recent version. Your continued use of SQWD after changes take effect constitutes your acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in New York.
